The most significant piece of crypto legislation in U.S. history is stuck in the Senate. President Trump just issued a warning: pass it, or watch the industry flee to China.

The CLARITY Act (Digital Asset Market Clarity Act of 2025) passed the House in July 2025 with a bipartisan 294-134 vote. It would finally resolve the decade-long jurisdictional war between the SEC and CFTC by classifying digital assets as either commodities (CFTC) or securities (SEC).

Bitcoin and Ethereum? Both commodities. That classification alone would unlock billions in institutional capital that has been sitting on the sidelines, waiting for regulatory clarity.

But as of March 2026, the bill is stalled. Banking industry opposition has killed compromise language. The Senate Banking Committee postponed debate indefinitely. And with midterm election season approaching, the legislative calendar is working against it.

What Trump Said

On March 3, Trump posted on Truth Social: "Failure to pass the CLARITY Act would drive the crypto industry to China and other competing jurisdictions."

It's not empty rhetoric. In the past 83 days, at least 11 crypto companies—including Circle, Ripple, and Coinbase—have filed for or received federal trust bank charters through the OCC. They're hedging. Legislative route or regulatory route, they need a path forward.
